The Hyperwisor platform is operated by:

Proprietary rights

The Hyperwisor platform — including its software, cloud services, SDKs, firmware libraries, dashboard and no-code builder, APIs, protocols, designs, user interfaces, workflows, and this documentation — is the exclusive intellectual property of NIKOLAINDUSTRY PRIVATE LIMITED and is protected by copyright, trade secret, and other intellectual-property laws. Nothing in this documentation transfers any ownership, and no rights are granted except the limited permitted use described below. All rights not expressly granted are reserved.

Permitted use

Subject to your agreement with NIKOLAINDUSTRY PRIVATE LIMITED and your account in good standing, you are granted a limited, non-exclusive, non-transferable, revocable right to use this documentation solely to:

• Build applications, dashboards, firmware, and devices that run on the Hyperwisor platform
• Integrate with Hyperwisor’s official SDKs and APIs as documented
• Operate your own products and services on top of Hyperwisor

That’s it. This documentation is a usage guide for building on the platform.

Restrictions

You may not, directly or indirectly:

• Copy, reproduce, or recreate the Hyperwisor platform, its services, architecture, protocols, or functionality, in whole or in part
• Use this documentation, the platform, or any part thereof to design, develop, train, or operate a competing product or service
• Reverse-engineer, decompile, or disassemble any part of the platform, SDKs, or services, except where such restriction is prohibited by law
• Reproduce, redistribute, publish, or create derivative works of this documentation without prior written permission
• Remove or obscure any proprietary, copyright, or trademark notices
• Use the platform or documentation to build a marketplace, dashboard builder, device-management service, or IoT platform that competes with Hyperwisor

SDK & library licensing

The firmware libraries are licensed separately — refer to each repository’s license:

• Hyperwisor Arduino library — proprietary; licensed for use exclusively with NIKOLAINDUSTRY PRIVATE LIMITED hardware and software platforms.
• Hyperwisor ESP-IDF component — Apache-2.0, per its LICENSE file.

Use of the platform and its cloud services is governed by these terms regardless of any individual library license.

Trademarks

“Hyperwisor,” “NIKOLAINDUSTRY,” the Hyperwisor logo, and related marks are trademarks of NIKOLAINDUSTRY PRIVATE LIMITED. No right to use them is granted by this documentation.

No warranty

This documentation and the platform are provided “as is”, without warranty of any kind, express or implied. NIKOLAINDUSTRY PRIVATE LIMITED does not warrant that the documentation is complete or error-free, and features may change.

Enforcement

Unauthorized use, reproduction, reverse-engineering, or misappropriation of the Hyperwisor platform or this documentation is a violation of these terms and applicable law, and may result in civil and criminal liability. NIKOLAINDUSTRY PRIVATE LIMITED will enforce its rights to the fullest extent available.

Governing law

These terms are governed by and construed in accordance with the laws of India. Any dispute is subject to the exclusive jurisdiction of the competent courts in Nashik, Maharashtra, India, without prejudice to either party’s right to seek emergency injunctive relief from any court of competent jurisdiction.
